Nhãn hiệu (NH) và tên thương mại (NH&TTM) là hai đối tượng quyền sở hữu trí tuệ (SHTT) phổ biến được các doanh nghiệp sử dụng trong hoạt động sản xuất, kinh doanh. Tuy nhiên, giữa hai đối tượng này lại thường xảy ra xung đột do một dấu hiệu có thể đồng thời được đăng ký/sử dụng với hai vai trò/chức năng khác nhau bởi hai chủ thể khác nhau. Trong những năm gần đây các vụ việc tranh chấp (...) giữa NH&TTM cũng trở nên thường xuyên hơn và có thể được giải quyết theo các cơ chế khác nhau (hành chính, dân sự hay hình sự). Bài viết giới thiệu một số tình huống tranh chấp giữa NH&TTM đã được giải quyết tại tòa án và đề xuất một số khuyến nghị về chính sách, pháp luật. (shrink)

Bài viết đánh giá các nhân tố tác động đến việc sử dụng QR-Code tại các cửa hàng tạp hóa trên địa bàn TP. Biên Hòa, tỉnh Đồng Nai. Kết quả nghiên cứu cho thấy, có 3 nhân tố ảnh hưởng đến việc sử dụng QR Code gồm: Tính dễ dàng thao tác; Tính nhanh chóng tiện lợi; Tính an toàn bảo mật. Từ đó, nghiên cứu kiến nghị đối với các ngân hàng và các tổ chức tín dụng cung (...) cấp dịch vụ QR Code đến người dân sử dụng rộng rãi hơn không chỉ ở khu vực thành thị, cũng như các khu vực nông thôn. Bài viết đánh giá thực trạng hoạt động hệ thống ngân hàng Việt Nam trong bối cảnh thực hiện đề án cơ cấu lại hệ thống các tổ chức tín dụng (TCTD). Kết quả nghiên cứu cho thấy, hoạt động tái cấu trúc ngân hàng đã diễn ra mạnh mẽ với chỉ đạo quyết liệt của Chính phủ và Ngân hàng nhà nước, đặc biệt trong phê duyệt chủ trương chuyển giao bắt buộc 4 ngân hàng diện kiểm soát đặc (...) biệt nhằm lành mạnh và ổn định hệ thống ngân hàng. Tuy nhiên, với thực trạng nền kinh tế suy thoái, những vấn đề về nợ xấu gia tăng vượt qua ngưỡng an toàn 3%, tỷ lệ bao phủ nợ xấu giảm xuống dưới 100%, tín dụng tăng trưởng chậm, biên lợi nhuận thu hẹp đang trở thành nguy cơ dẫn dến rủi ro hoạt động của hệ thống ngân hàng Việt Nam. Trước thực trạng đó, tác giả đưa ra một số khuyến nghị chính sách nhằm nâng cao hiệu quả tái cơ cấu hệ thống ngân hàng. (shrink)

Hiện nay, chế độ sở hữu ở Việt Nam đã có những đổi mới cơ bản, nhưng vẫn còn những khác biệt rất lớn so với chế độ sở hữu ở các nền kinh tế thị trường hiện đại. Trong cơ cấu của chế độ sở hữu ở Việt Nam, tỷ trọng của sở hữu nhà nước còn quá lớn; kinh tế nhà nước giữ vai trò chủ đạo… Chính những khác biệt này đã làm cho nền kinh tế thị (...) trường Việt Nam bị méo mó và giảm lợi thế cạnh tranh quốc gia. Do vậy, công cuộc đổi mới và hoàn thiện chế độ sở hữu ở Việt Nam phải hướng tới việc khắc phục những hạn chế trên và đạt tới sức cạnh tranh ngang hàng với các nền kinh tế thị trường hiện đại khác. Trong nghị sự khẩn trương thúc đẩy nhịp độ phát triển kinh tế đầu Xuân 2024, ngày 28-2 báo chí kinh tế Việt Nam đồng loạt đưa tin về sự kiện Thủ tướng Chính phủ Phạm Minh Chính đã tham dự chỉ đạo tại Hội nghị triển khai nhiệm vụ phát triển thị trường chứng khoán (TTCK) 2024. Họ là những người tiên phong trong việc áp dụng công nghệ mới và thúc đẩy hiện đại hóa ngân hàng. Đảng viên trẻ tại VietinBank cần nâng cao nhận thức tư tưởng, tiên phong trong ứng dụng công nghệ và thực hiện các nguyên (...) tắc ESG (Môi trường, Xã hội và Quản trị) để phát triển bền vững. Đảng ủy và Ban lãnh đạo cần hỗ trợ qua đào tạo, tạo môi trường làm việc linh hoạt và định hướng chiến lược rõ ràng. Vào ngày 3 tháng 9 năm 2022, Retraction Watch thông báo rằng bốn bài báo được xuất bản trong Proceedings of the National Academy of Sciences (PNAS) đã bị rút vào cùng một ngày (02 tháng 9 năm 2022). Đáng chú ý hơn là cả bốn bài đều có tác giả chung là Gregg Semenza, một nhà nghiên cứu hàng đầu về cơ chế phân tử của quá trình điều chỉnh oxy – Gregg Semenza. Semenza đã chia sẻ Giải Nobel (...) Trung Quốc là nền kinh tế lớn hàng đầu thế giới, vận hành với hiệu suất cao để đáp ứng nhu cầu sinh kế của hơn 1,4 tỷ người dân, và cung cấp một lượng hàng hóa công nghệ, tiêu dùng và cả nông phẩm tới thế giới. Hệ quả tất yếu của quá trình tăng trưởng liên tục hơn 4 thập niên là việc sử dụng tài nguyên, và trong quá trình sản xuất, chế tạo, chế biến cũng sản (...) sinh ra một lượng khí nhà kính (GHG) tích lũy khổng lồ phát thải vào khí quyển. Trong một thống kê được đăng trên The Guardian năm 2017, thế giới đã nhận thấy trong giai đoạn 1988-2015, 100 tổ hợp công nghiệp hàng đầu thế giới chịu trách nhiệm cho việc phát thải tới 71% tổng tồn lượng GHG trong khí quyển. Dẫn đầu danh sách này trên phương diện quốc gia là Trung Quốc, với thống kê chỉ 5 đại công ty Trung Quốc đã chiếm tới gần 17% tổng lượng phát thải, trong đó tổ hợp ngành than có trách nhiệm lớn nhất, tới 14,32%. Sau những tiến bộ công nghệ vượt bậc cũng như tích lũy thặng dư nền kinh tế, quá trình hiện đại hóa ở Trung Quốc sang thời kỳ Chủ tịch Tập Cận Bình đã chuyển hướng sang bảo vệ môi trường với các mục tiêu phát thải nghiêm ngặt. Type identity theory was dismissed in 1967 by many philosophers due to Hilary Putnam’s multiple realisability objection seeming fatal. This paper delves into a critique of type identity theory, thereby paving the way for introducing an alternative theory of mind: emergentism. The longstanding philosophical discourse around the mind has been dominated by the binary opposition of classical physicalist and dualist theories. However, the impact of scientific discovery on contemporary thought has sparked an increasing inclination towards reductive physicalist frameworks, with the (...) aim of aligning with the scientific method. Thus, contemporary thinkers have branched out to explore new physicalistic ideas. This paper examines the inherent challenges in all reductive physicalist theories, shedding light on their limitations and proposing potential solutions to overcome the obstacles. This analysis demonstrates that type identity theory, akin to its reductive counterparts, fails to accommodate for the irreducibility of consciousness. This is consciousness as characterised by Thomas Nagel’s “what is it likeness” of experience, which is inherently subjective. Instead, this paper contends that emergentism offers a compelling alternative despite being a physicalist theory. It posits consciousness as a higher-order phenomenon, one that transcends reduction to its constituent components. I argue that this attribute of emergentism makes it a promising theory in the ongoing quest for an understanding of the mind and consciousness. (shrink)

We review the literature for the long-term effects of war on human capital. We document the negative effects of exposure to war on individual health, prospective earnings, educational attainment, prospective earnings, and labor productivity in the long run. The findings call for immediate and effective actions to reduce the detrimental repercussions of war in both the short run and long run.

The paper focuses itself on discussing the trend and practice of entrepreneurship education and training (EET) at tertiary level in the world. The author also supports the idea that entrepreneurship can be learnt through EET programs under certain circumstances. After examining the Vietnamese context for private entrepreneurs, including the government’s policy and the practice on startup since its independence in 1945, his analysis shows that Vietnam is a prospective market not only for domestic business people but also for foreign investors. Then, with the massive influx of fresh graduates who are well prepared for job seeking, he recommends introducing EET programs formally to nurture entrepreneurial spirit among university students. It is supposed that the inclusion of EET programs at the tertiary level not only helps minimize the unemployment rate among new graduates on the present-day labor market but also contributes to generating jobs for others. Algorithms can now identify patterns and correlations in the (big) datasets, and predict outcomes based on those identified patterns and correlations with the use of machine learning techniques and big data, decisions can then be made by algorithms themselves in accordance with the predicted outcomes. Yet, algorithms can inherit questionable values from the datasets and acquire biases in the course of (machine) learning, and automated algorithmic decision-making makes it more difficult for people to see algorithms as biased. While researchers have (...) taken the problem of algorithmic bias seriously, but the current discussion on algorithmic fairness tends to conceptualize ‘fairness’ in algorithmic fairness primarily as a technical issue and attempts to implement pre-existing ideas of ‘fairness’ into algorithms. In this paper, I show that such a view of algorithmic fairness as technical issue is unsatisfactory for the type of problem algorithmic fairness presents. Since decisions on fairness measure and the related techniques for algorithms essentially involve choices between competing values, ‘fairness’ in algorithmic fairness should be conceptualized first and foremost as a political issue, and it should be (re)solved by democratic communication. The aim of this paper, therefore, is to explicitly reconceptualize algorithmic fairness as a political question and suggest the current discussion of algorithmic fairness can be strengthened by adopting the accountability for reasonableness framework. A closer look at the theories and questions in philosophy of technology and ethics of technology shows the absence and marginality of non-Western philosophical traditions in the discussions. Although, increasingly, some philosophers have sought to introduce non-Western philosophical traditions into the debates, there are few systematic attempts to construct and articulate general accounts of ethics and technology based on other philosophical traditions. In this article, we focus on the C-Manuscripts to see how Husserl reflects on the margins of phenomenality with reference to the three limit-phenomena of sleep, death, and others. We choose to juxtapose these three limit-phenomena, because in the C-Manuscripts Husserl has depicted their affinities, both in terms of their phenomenal characters and their transcendental functions, in a creative way. There Husserl has outlined at least two approaches for introducing the limit-phenomena of sleep, death, and others to the core concerns (...) of phenomenology. These two approaches rely on different heuristic strategies to shed light on the genetic constitution of monadic life and the generative constitution of humanity respectively. The first approach privileges sleep as the model of unconscious pause in order to illuminate the more perplexing cases of death and others. The second approach treats sleep and death as bridging-members of the constitution of the total human world, after the model of others in the constitution of transcendental intersubjectivity. The aim of Intercultural Information Ethics (IIE), as Ess aptly puts, is to “(a) address both local and global issues evoked by ICTs / CMC, etc., (b) in a ways that both sustain local traditions / values / preference, etc. and (c) provide shared, (quasi-) universal responses to central ethical problems” (Ess 2007a, 102). This formulation of the aim of IIE, however, is not unambiguous. In this paper, I will discuss two different understandings of the aim of IIE, one of (...) which advocates “shared norms, different interpretations” and another proposes “shared norms, different justifications”. I shall argue that the first understanding is untenable, and the second understanding is acceptable only with qualification. The burgeoning literature on the ethical issues raised by climate engineering has explored various normative questions associated with the research and deployment of climate engineering, and has examined a number of responses to them. While researchers have noted the ethical issues from climate engineering are global in nature, much of the discussion proceeds predominately with ethical framework in the Anglo-American and European traditions, which presume particular normative standpoints and understandings of human–nature relationship. The current discussion on the ethical issues, therefore, (...) is far from being a genuine global dialogue. The aim of this article is to address the lack of intercultural exchange by exploring the ethics of climate engineering from a perspective of Confucian environmental ethics. Drawing from the existing discussion on Confucian environmental ethics and Confucian ethics of technology, I discuss what Confucian ethics can contribute to the ethical debate on climate engineering. Entrepreneurship plays an indispensable role in the economic development and poverty reduction of emerging economies like Vietnam. The rapid development of technologies during the Fourth Industrial Revolution (Industry 4.0) has a significant impact on business in every field, especially in the innovation-focused area of entrepreneurship. However, the topic of entrepreneurial activities with technology applications in Vietnam is under-researched. In addition, the body of literature regarding entrepreneurial finance tends to focus on advanced economies, while mostly neglecting the contextual differences in developing (...) nations. Therefore, this research contributes to these topics by investigating the main characteristics of a high potential market for entrepreneurs in Vietnam, which is the English language training market (ELTM). It also aims at indicating the impacts of technology on the entrepreneurial firms within this market, with an emphasis on financing sources. To answer the research questions, this study employs a qualitative analysis and conducts 12 in-depth, semi-structured interviews with entrepreneurs and researchers in the field. The key findings in our study highlight the main contributing factors to the growth of the market, both universally and context-specific for a developing nation like Vietnam. It also lists the leaders in each market segment and the industry’s potential profit margin. The results also show that most entrepreneurs in the ELTM utilized private sources of finance rather than external ones, such as bank loans. It again confirms the idea from previous works that even with the rapid development of the economic and technological landscape, entrepreneurial activities in general barely benefit from additional sources of funding. However, it also points out the distinct characteristics of the ELTM that may influence these financing issues; for example, English training services usually collect revenues from customers before delivering their classes. This is of advantage for entrepreneurs in this area and helps significantly reduce the financial barriers. These findings, which are among the first attempts to contribute to a better understanding of entrepreneurial opportunities in the Industry 4.0 in Vietnam, provide valuable insights for policymakers and entrepreneurs, as well as investors. It is hard to disagree with the idea of responsible innovation (henceforth, RI), as it enables policy-makers, scientists, technology developers, and the public to better understand and respond to the social, ethical, and policy challenges raised by new and emerging technologies. RI has gained prominence in policy agenda in Europe and the United States over the last few years. And, along with its rising importance in policy-making, there is also a burgeoning research literature on the topic. Given the historical context (...) of which RI emerges, it should not be surprising that the current discourse on RI is predominantly based on liberal democratic values. Yet, the bias towards liberal democratic values will inevitably limit the discussion of RI, especially in the cases where liberal democratic values are not taken for granted. As such, there is an urgent need to return to the normative foundation of RI, and to explore the notion of ‘responsible innovation’ from nonliberal democratic perspectives. Against this background, this paper seeks to demonstrate the problematic consequences of RI solely grounded on or justified by liberal democratic values. This paper will cast the argument in the form of a dilemma to be labelled as The Decent Nonliberal Peoples’ Dilemma and use it to illustrate the problems of the Western bias. (shrink)

International observers and critics often attack China's Internet policy on the basis of liberal values. If China's Internet is designed and built on Confucian values that are distinct from, and sometimes incompatible to, liberal values, then the liberalist critique ought to be reconsidered. In this respect, Mary Bockover's “Confucian Values and the Internet: A Potential Conflict” appears to be the most direct attempt to address this issue. Yet, in light of developments since its publication in 2003, it is time to (...) re-examine this issue. In this paper, I revisit Bockover’s argument and show why it fails. Using social media as an example, I offer an alternative argument to show why the Internet remains largely incompatible with Confucian values. I end this paper by suggesting how to recontextualise the Confucian way of life and to redesign social media in accordance to Confucian values in the information society. (shrink)

Philosophers have talked to each other about moral issues concerning technology, but few of them have talked about issues of technology and the good life, and even fewer have talked about technology and the good life with the public in the form of recommendation. In effect, recommendations for various technologies are often left to technologists and gurus. Given the potential benefits of informing the public on their impacts on the good life, however, this is a curious state of affairs. In (...) the present paper, I will examine why philosophers are seemingly reluctant to offer recommendations to the public. While there are many reasons for philosophers to refrain from offering recommendations, I shall focus on a specific normative reason. More specifically, it appears that, according to a particular definition, offering recommendations can be viewed as paternalistic, and therefore is prima facie wrong to do so. I will provide an argument to show that the worry about paternalism is unfounded, because a form of paternalism engendered by technology is inevitable. Given the inevitability of paternalism, I note that philosophers should accept the duty to offer recommendations to the public. I will then briefly turn to design ethics, which has reconceptualised the role of philosophers and, in my mind, fitted well with the inevitability of paternalism. Finally, I shall argue that design ethics has to be supplemented by the practice of recommendation if it is to sustain its objective. (shrink)

Researchers have explored questions concerning public participation and consent in geoengineering governance. Yet, the notion of consent has received little attention from researchers, and it is rarely discussed explicitly, despite being prescribed as a normative requirement for geoengineering research and being used in rejecting some geoengineering options. As it is noted in the leading geoengineering governance principles, i.e. the Oxford Principles, there are different conceptions of consent; the idea of consent ought to be unpacked more carefully if, and when, we (...) invoke it in the discussion. This article offers a theoretical reflection on different conceptions of consent and their place in geoengineering governance. More specifically, I discuss three models of consent, i.e. explicit consent, implied consent and hypothetical consent, and assess their applicability to geoengineering governance. Although there are different models of consent, much discussion of geoengineering governance has committed only to explicit consent. I note that such a commitment springs from a specific ideal political order. Accordingly, we should be wary of any naïve commitment to it so long as the political order we hope for remains open to debate. Finally, I illustrate two approaches to introduce consent into a geoengineering governance framework. (shrink)

In response to the Royal Society report’s claim that “the acceptability of geo­engineering will be determined as much by social, legal, and political issues as by scientific and technical factors” (Geoengineering the Climate: Science, Governance and Uncertainty [London: Royal Society, 2009], ix), a number of authors have suggested the key to this challenge is to engage the public in geoengineering decision-making. In effect, some have argued that inclusion of the public in geoengineering decision-making is necessary for any geoengineering project to (...) be morally permissible. Yet, while public engagement on geoengineering comes in various forms, the discussion in geoengineering governance and the ethics of geoengineering have too often conceptualized it exclusively in terms of public participation in decision-making, and supported it by various liberal democratic values. However, if the predominant understanding of public engagement on—or, the role of the public in—geoengineering decision-making is indeed only grounded on liberal democratic values, then its normative relevance could be challenged by and in other ethical-political traditions that do not share those values. In this paper, I shall explore these questions from a Confucian perspective. I argue that the liberal democratic values invoked in support of the normative importance of public participation are, at least, foreign to Confucian political philosophy. This presents a prima facie challenge to view public participation in geoengineering decision-making as a universal moral requirement, and invites us to reconsider the normative significance of this form of public engagement in Confucian societies. Yet, I contend that the role of the public remains normatively significant in geoengineering governance and the ethics of geoengineering from a Confucian perspective. Drawing from recent work on Confucian political philosophy, I illustrate the potential normative foundation for public engagement on geoengineering decision-making. (shrink)

The paper also offers an additional argument for the indispensability of prudential appraisals of ICTs in normative analysis of ICTs and the good life, (...) which in turn strengthens the basis for the Walzerian approach proposed in the paper.FindingsIt is argued that an interpretive approach to normative analysis of ICTs and the good life, i.e. the Walzerian approach, is as viable as – if not superior to – a theory‐driven approach. It is also argued that actual appraisals of ICTs and the good life must be taken into account in the normative analysis.Originality/valueIt is only recently that “the good life” has become more visible in normative analysis of ICTs. Vietnam, with a geographical proximity and a high volume of trade with China, was the first country to record an outbreak of the new Coronavirus disease (COVID-19), caused by the Severe Acute Respiratory Syndrome Coronavirus 2 or SARS-CoV-2. While the country was expected to have a high risk of transmission, as of April 4, 2020—in comparison to attempts to contain the disease around the world—responses from Vietnam are being seen as prompt and effective in protecting the interests of its citizens, (...) with 239 confirmed cases and no fatalities. This study analyzes the situation in terms of Vietnam’s policy response, social media and science journalism. A self-made web crawl engine was used to scan and collect official media news related to COVID-19 between the beginning of January and April 4, yielding a comprehensive dataset of 14,952 news items. The findings shed light on how Vietnam—despite being under-resourced—has demonstrated political readiness to combat the emerging pandemic since the earliest days. Timely communication on any developments of the outbreak from the government and the media, combined with up-to-date research on the new virus by the Vietnamese science community, have altogether provided reliable sources of information. By emphasizing the need for immediate and genuine cooperation between government, civil society and private individuals, the case study offers valuable lessons for other nations concerning not only the concurrent fight against the COVID-19 pandemic but also the overall responses to a public health crisis. The ethics of geoengineering has gained momentum in recent academic debate. The current debates, however, is typically framed in terms of (i) the first-order question about the moral permissibility of geoengineering, and (ii) the second-order question about the distributive and compensatory issues associated with geoengineering. Both (i) and (ii) are central to decision-making about geoengineering, but they have not cover all ethical issues related to geoengineering. I argue that a preoccupation with (i) and (ii) may lead to an oversight of (...) post-implementation scenarios (PISs), which introduce different ethical issues relevant to decision-making on geoengineering. More specifically, I use the requirement of maintenance for geoengineering as an example to draw attention to PISs, and to illustrate the limit of the existing discussion in the ethics of geoengineering. In Information and Computer Ethics (ICE), and, in fact, in normative and evaluative research of Information Technology (IT) in general, researchers have paid few attentions to the prudential values of IT. Hence, analyses of the prudential values of IT are mostly found in popular discourse. Yet, the analyses of the prudential values of IT are important for answering normative questions about people’s well-being. In this chapter, the author urges researchers in ICE to take the analyses of the prudential values of (...) IT seriously. A serious study of the analyses, he argues, will enrich the research of ICE. But, what are the analyses? The author will distinguish the analyses of the prudential values of IT, i.e. the prudential analysis, from other types of normative and evaluative analysis of IT. Then, the author will explain why prudential analyses are not taken seriously by the researchers in ICE, and argue why they deserve more attentions. After that, he will outline a framework to analyse and evaluate prudential analyses, and he will apply the framework to an actual prudential analysis. Finally, he will briefly conclude this chapter by highlighting the limits of the proposed framework and identifying the directions for future research. (shrink)

Nearly a decade ago, Rafael Capurro has gradually shifted his attention towards the ideas of message and of messenger. In lieu of ‘information’, he proposes and develops a new direction of research he calls Angeletics that aims to examine the nature of message and messenger, both of which are inherently social. Coincidently, at about the same time, we witnessed the rise of social epistemology in Angelo-American analytic philosophy. This coincidence is interesting, because both Capurro’s Angeletics and social epistemology indicated a (...) departure from individualistic-orientedness in hermeneutics and traditional epistemology respectively. While social epistemology has earned its place and status in academia, especially in North America and Europe, Capurro’s Angeletics has yet to receive similar attention to which it deserves. Part of the reason for this, I think, is because of its formulation and terminology is relatively unfamiliar to those who do not share the same philosophical tradition. Hence, one remedy to this situation is to attempt to translate Angeletics in terms of social epistemology, and this – is the objective of the current paper. (shrink)

This paper discusses the influence of digital media and its online presence on freedom of speech in Vietnam by analyzing three different kinds of emerging online media tools: blogosphere, electronic/online newspapers, and social media networks (SNSs). As a single- party socialist republic country, the controlling power of the media lays in the hands of the Communist Party of Vietnam (CPV). The Doi Moi reform in 1986, marketization and the introduction of the Internet in 1997 have slightly transformed the Vietnamese media (...) environment, however, it remains highly restricted. This paper explores several sources including academic research, research articles, as well as analysis of online press coverage in the Vietnamese media environment to examine governmental control over the media which influences the free flow of information. Understanding digital media developments within the Vietnamese online media environment helps us to understand how Vietnamese netizens utilize these tools to maximize their online freedom of speech, the CPV"s approach to regulate the Internet in order to maintain its legitimacy, and several challenges facing Vietnamese netizens including bloggers, journalists, and the wider public in the digital age.
